Terms and Conditions for Aspire Dog Training

Please read these Terms and Conditions carefully. They are in place to ensure the smooth and safe running of all dog training sessions, including individual and group training. By booking or participating in any training services with Aspire Dog Training ("we," "us," or "our"), you ("Client," "you," or "your") agree to understand and accept these terms in full. If anything is unclear, please ask your trainer for clarification.

All bookings with Aspire Dog Training, whether pending or confirmed, are subject to these terms and conditions.

1. Services Offered

Aspire Dog Training provides professional dog training services, including:

  • 1-to-1 Sessions: Tailored training sessions conducted at your home, a neutral venue (e.g., a park or field), or a hired hall.

  • Group Sessions & Workshops: Structured training classes conducted at neutral venues (e.g., a park or field) or a hired hall.

Our services aim to provide guidance and instruction to dog owners to improve their dog's behaviour and obedience. While we will discuss desired outcomes and tailor recommendations for realistic results, we cannot guarantee specific training or behavioural outcomes. Results depend on many factors, including your consistent practice, your dog's individual temperament, and your commitment.

2. Client Conduct and Responsibilities

As a client, you agree to:

  • Provide Accurate Information: Give us truthful, accurate, and complete information about yourself, your dog's behaviour, history, and any relevant medical conditions or circumstances.

  • Dog's Health & Vaccinations: Ensure your dog is up-to-date with all necessary vaccinations, flea/worming treatments, and is in good health for training. Inform us immediately of any changes to your dog's health or behaviour that may affect training.

  • Punctuality: Be punctual for all scheduled sessions.

  • Follow Instructions: Follow all instructions provided by your trainer during sessions and practice consistently between sessions.

  • Dog Control: Keep your dog under control at all times. Your safety, your dog’s safety, and the safety of other participants are your responsibility.

  • Responsible Behaviour: Act responsibly and sensibly at all times during training sessions.

  • Multiple Dogs: If you bring multiple dogs to a session, one capable handler must be available for each dog.

  • Handler Capability: All attendees and dog handlers must be sober and mentally and physically capable of managing the dog(s) they are handling.

  • Children: Children under the age of 16 must be accompanied by an adult at all times.

  • Equipment Use: Use any equipment as directed by your trainer or in provided training materials. Use equipment sensibly and as intended, following all safety instructions to prevent injury to yourself, other people, your dog, or other animals.

  • Ethical Training: Our training methods are kind and ethical. We do not support aversive methods such as choke chains, prong collars, or electric shock collars. Harsh handling during training sessions will not be tolerated.

3. Client Disclosure and Safety

By engaging with Aspire Dog Training services, you confirm that all information provided about your dog’s behaviour, history, and relevant circumstances is truthful, accurate, and complete to the best of your knowledge.

  • Risk of Non-Disclosure: You acknowledge that withholding, misrepresenting, or failing to disclose important information (such as previous aggression, medical conditions, or behavioural concerns) may pose a significant risk to the safety of your trainer, yourself, your dog, and others.

  • Legal Duty of Care: Under the Animal Welfare Act 2006, all animal owners and keepers have a legal duty of care to ensure the welfare of their animals and to prevent harm to others. The Dangerous Dogs Act 1991 and related legislation impose additional responsibilities to prevent a dog from being dangerously out of control.

  • Consequences of Non-Disclosure: Failure to provide full and honest disclosure may result in the immediate termination of services without refund. Aspire Dog Training shall not be held liable for any consequences arising from such omissions. You accept full responsibility for any legal repercussions that may arise from undisclosed behavioural issues or other relevant factors.

4. Session Specifics

4.1. 1-to-1 Sessions (Home Visits)

  • During home visits, please ensure your dog is safely contained in a room away from the entrance when the trainer arrives. Your trainer will advise you when and how to introduce your dog.

4.2. Group Sessions & Workshops

  • Dog Control: Dogs must be kept under the handler’s control and on a lead at all times, unless specifically instructed otherwise by the trainer. You are responsible for the conduct of your dog at all times.

  • Arrival Etiquette: When arriving at classes or workshops, please avoid allowing your dog to greet other dogs on lead. Not all dogs are comfortable with on-lead greetings. Do not crowd doorways or gates, and allow plenty of room for other dogs to enter and exit.

  • Waste Management: Please be a responsible dog owner and always clean up after your dog. Take home or properly dispose of all used poo bags.

  • Dog Health for Group Sessions: The welfare and safety of all dogs are paramount. Do not bring your dog to class if they are in an unfit state of health due to illness, disease, or injury, or if they have been in contact with an infectious disease (e.g., kennel cough, conjunctivitis).

  • Bitches in Season: Bitches in season should not be brought to group training classes, workshops, or trailing sessions.

  • Outdoor Sessions: Some group sessions may be held outdoors where terrain can be uneven and slippery. Our training involves practical handling; therefore, appropriate, comfortable, and flat footwear and clothing are recommended. You may be required to get down on the ground, so suitable attire is advised.

  • Minimum Numbers: Insufficient numbers booked onto a course or workshop may result in it being postponed or cancelled. In such cases, you will be notified of future dates or offered private tuition. If these options are not suitable, a full refund for that specific course/workshop will be given.

5. Health and Safety

The welfare of the animals and the safety of all participants are our top priority. Any breaches of the Animal Welfare Act (2006) will be addressed accordingly.

  • Precautions for Behavioural Issues: Particularly for dogs with a bite history or known behavioural issues, suitable precautions (such as the use of a muzzle or other management tools) must be implemented as advised by your trainer.

  • Vaccination Requirement: All dogs participating in dog training must be fully vaccinated.

  • Dangerous Dogs Act 1991: We are unable to work with dogs of breeds covered by the Dangerous Dogs Act (DDA 1991), as this is not covered by our insurance.

6. Booking, Payments and Cancellations

  • Quotes: A quote for the agreed training session(s) or package will be provided at the time of booking.

  • Payment Due: All quoted fees must be paid before the first session commences, unless otherwise agreed.

  • Client Cancellation/Rescheduling:

    • For 1-to-1 sessions: A minimum of 48 hours' notice is required for cancellations or rescheduling. If less than 48 hours' notice is given, the full session fee will be charged.

    • For Group Sessions/Courses: Specific cancellation and refund policies for group sessions or courses will be outlined at the time of booking. Generally, refunds are not provided for missed sessions or cancellations once a course has commenced.

  • Missed Sessions: If the client misses a class or session without providing the required notice, no refund will be issued.

  • Aspire Dog Training Cancellation/Rescheduling: In the rare event that Aspire Dog Training needs to cancel or reschedule a session (e.g., due to trainer illness, adverse weather, or emergency), we will provide as much notice as possible and offer an alternative date or a full refund for the cancelled session.

7. Limitation of Liability

  • Aspire Dog Training will take all reasonable care in providing training services. However, you acknowledge that working with animals involves inherent risks, including but not limited to injury to yourself, other people, your own dog, and other animals. Your participation in any training sessions is entirely at your own risk.

  • In the absence of any negligence or other breach of duty by us, we are not responsible for:

    • Any injury, loss, or damage to persons, dogs, or property arising from participation in our sessions.

    • Any damage, destruction, or loss of your property while participating in our training sessions.

    • Any loss or injury arising from an act or omission by you or your dog. This includes, but is not limited to:

      • Circumstances where your dog attacks you as the owner/handler, another person, another dog, or another animal.

      • Veterinary bills for any injury caused to your dog or a third party’s dog as a result of participating in dog training.

      • Medical bills for any injury caused to you or a third party as a result of participating in the training.

      • Bills for damage to property caused by you or your dog as a result of participating in the training.

  • You agree to indemnify and hold harmless Aspire Dog Training from any and all claims, losses, damages, liabilities, and expenses (including legal fees) arising from your dog's behaviour or your breach of these Terms and Conditions.

8. Intellectual Property & Media

  • All training materials, handouts, methods, and content provided by Aspire Dog Training are our intellectual property and are for your personal use only. They may not be reproduced, distributed, shared with others, or used for commercial purposes without our express written consent. Training plans and advice are specific to your handler/dog combination and should not be implemented by other individuals or with other animals.

  • During training sessions, clients are not permitted to take photographs or videos without express permission from the trainer and all other participants. Similarly, if the trainer wishes to take pictures or videos during a session, your permission will be sought.

9. Data Protection and Confidentiality

All client data is kept confidential in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

When you supply your personal details to Aspire Dog Training, they are stored and processed for the following reasons:

  1. Legitimate Interest: We need to collect personal information to provide our services safely and effectively.

  2. Consent: Provided we have your consent, we may occasionally email you news, updates, announcements, and offers for our training courses. You may withdraw this consent at any time by emailing us.

  • Data Retention: We have a legal obligation to retain our records about you for seven years after your most recent appointment. After this period, you can ask us to delete our records about you. Otherwise, we may retain our records about you indefinitely to provide the best possible service if you contact us again in the future.

  • Data Storage: Your records are stored securely on paper at our premises (in a locked filing cabinet) and on our email systems (which are hosted by a third party and secured by password). Only authorised personnel at Aspire Dog Training will have routine access to your data.

  • Data Sharing: We will never pass your details on to other parties without your explicit consent, except where required by law.

  • Your Rights: You have the right to see what personal data of yours we hold, and you can ask us to correct any factual errors. Provided the legal minimum retention period has elapsed, you can also ask us to erase your records by emailing us.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms and Conditions

We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on our website, and the "Last Updated" date will be revised. It is your responsibility to read these terms and conditions and to seek clarification if needed. Your continued use of our services after any such changes constitutes your acceptance of the new Terms and Conditions.
